Controlled Unclassified information (CUI) covers any information the Government creates or possesses, or that an entity creates or possesses for or on behalf of the Government, that is required to be protected under law, regulation, or Government-wide policy. CUI access is limited by the controlling government agency to persons and parties provided for by the accompanying distribution control statement. It is important to remember that licensing acquired authorizing the export of controlled technical data (State Department) and technology (BIS) does not authorize release of technology or technical data that is marked as CUI or with a DOD Distribution Statement restricting public access. For parties/persons licensed as end users or consignees not permitted access to the technology/technical data marked as CUI by the distribution control statement, a release must be obtained from the CUI holder prior to export.
