Last month President Trump agreed to grant exceptions to export license applications involving Huawei, a company listed on the Commerce Department’s Entity List, as long as those exports do not affect national security. It was also reported by The Wall Street Journal that Treasury Secretary Steven Mnuchin had urged U.S. suppliers to seek licenses and resume sales to Huawei. The Treasury Department later denied that Secretary Mnuchin urged companies to do so. Regardless of statements from the President or Treasury (which does not administer the Entity List), all export license applications involving Huawei will still be treated with a presumption of denial, meaning you need to provide compelling evidence as to why your transaction should be approved and that it will not affect national security.
