The U.S. Department of Commerce’s Bureau of Industry and Security (BIS) 50% rule, the “Affiliates Rule, (https://www.federalregister.gov/documents/2025/09/30/2025-19001/expansion-of-end-user-controls-to-cover-affiliates-of-certain-listed-entities) that was suspended through November 9, 2026, has been further suspended through January 10, 2027, while the agency considers next steps.
The Federal Register has not yet officially updated the November 10, 2026 date.
We recommend monitoring our blog or BIS publications for official notice of any further extensions of the pause or if the “Affiliates Rule” is fully implemented. The footnote regarding the suspension of the “Affiliates Rule” that was included in your most recent Policies and Procedures update should be updated with the new January 10th date. If you would like our office to make this change, please contact us.
