Boeing Reaches $51 Million Settlement for Export Violations

On February 28th, Boeing announced it had reached a $51 million settlement with the U.S. government over export violations related to technical data downloaded by Chinese citizen employees in China. The settlement underscores the importance of ensuring that your company has adequate controls related to technical data/technology. All technical data should be accessible only to those employees who are authorized U.S. persons or authorized foreign persons with required licensing authority or whose nationality does not require authorization, who require access for their job. Controlled licensable technical data should only be stored in secure locations, the files should be password protected and accessible only to those authorized employees. Authorization to transfer technical data and technology should be limited to designated employees following a review of licensing requirements by the Export Control Officer or other designated official.
